How to avoid claims for unjustified dismissal (and save yourself lawyer's fees!)

Isn't it frustrating to go through the arduous task of employing someone only to find they are not suitable? Frustrating it may be, but that's when your problems really start. Even if you have a genuine reason for dismissal, how do you then go about it without exposing yourself to a claim for unjustified dismissal? What if I told you there was a fail safe system for dismissing staff without leaving yourself exposed?

Dismissals are costly

Anyone who has had to dismiss a member of staff knows it is a costly exercise. If you're cautious you will get a legal opinion on how you should go about the dismissal: that could cost anywhere upwards of $500 depending on the nature of your problem and the lawyers you use. If you're not so cautious you'll give it a go yourself. If you make a mistake you could end up with a claim for unjustified dismissal. That's when the cost really starts to rocket. First there is the claim itself which is likely to be several thousand dollars and any legal fees incurred mounting a defence or negotiating a settlement. A bill for over $20,000 would not be unusual.

Take the uncertainty out of dismissals
